Please read the following Membership Agreement before registering for a Fall in Eyez(R) member's account. Registering a member's account is taken as acceptance of the membership agreement.

Fall in Eyez(R)  Online Membership Agreement

Destiny International Co., Ltd. (hereafter referred to as the "Company"), operator of the Fall in Eyez(R) website (hereafter referred to as the "website"), established the following Fall in Eyez(R) Online Membership Agreement (hereafter referred to as the "agreement").

Article 1: Definitions
  1. 1.Fall in Eyez(R) member's account members (hereafter referred to as "members") means people who have applied for membership according to a method established by the Company and who have subsequently been approved by the Company. The Company may refuse to approve membership should it determine that the applicant is in violation of Article 8.
  2. 2.Fall in Eyez(R) member's account services (hereafter referred to as the "services") means all services provided only to members of the website. The content of the services shall be recorded on a page on the website announcing the services.
  3. 3. Points are awarded at 3% the value of a product's purchase price. However, should awarded points be used for a purchase, points are awarded at 3% of the product purchase price minus the amount of points used.
Article 2: Registration
  1. 1.Persons wishing to use the services shall apply to become members via a process mediated through the website after agreeing to the agreement.
Article 3: Member ID and password
  1. 1.The company shall issue members with a member ID and password.
  2. 2.Members must not transfer or lend their member ID or password to a third party.
  3. 3.Member's shall manage their password in such a way that it is not leaked to a third party on their own responsibility.
Article 4. Prohibition of transfer of member rights
  1. 1.Members shall not transfer their rights to use the services to a third party.
Article 5: Member information
  1. 1. Should a member's information such as their postal code, address, email address, and telephone number change, that member will quickly update their information via a procedure established on the website.
  2. 2.The company shall handle members' personal information according to the Privacy Policy established on the website.
Article 6: Sending of information
  1. 1.Members shall agree to receive information, in whole or in part, on products, services, or events, etc. provided by the Company via methods including email and physical mail, etc.
  2. 2. Regardless of the preceding paragraph, the Company may contact members as part of the operation of the website, limited to when the Company determines that it is a matter of special importance, regardless of whether a given member has consented to such communication or not.
Article 7: Withdrawal
  1. 1.A member may withdraw their membership at any time via a procedure established on the website.
Article 8: Prohibited acts

Members shall not engage in the following acts when using the services.

  1. 1.Any of the following in relation to another member or third party.
  1. 1.Acts which infringe on portrait rights, copyright, or other intellectual property rights.
  2. 2.Acts which defame.
  3. 3.Acts which tarnish trust.
  4. 4.Acts which obstruct business.
  5. 5.All acts which involve discrimination, slander, threats, or privacy or human rights violations.
  6. 6.Acts which involve gambling.
  1. 2.Acts opposed to public order and morals.
  2. 3. Acts which involve private solicitation or the buying and selling of items.
  3. 4.Political, election, or religious activities.
  4. 5.Acts which use information obtained through the services that exceed the scope of personal use for purposes such as reproduction, sale, and publication.
  5. 6.Provision of information for the purposes of business activities or profit making through the use of the services.
  6. 7.Acts which hinder the operation of the services.
  7. 8.Acts which violate laws and ordinances.
  8. 9.Acts which involve sending or writing harmful computer programs, etc.
  9. 10.Acts which involve sending or writing spam mail, junk mail, or other mass emails targeted at large groups of unspecified people.
  10. 11.Using information provided by the services for written works, etc. for purposes other than one's own personal use, acts which retransmit information provided by the services to the general public regardless or whether inter- or intranet work, and acts which otherwise infringe on the copyright of a third party.
  11. 12.Acts which conform to the preceding paragraphs or are likely to.
Article 9: Cancellation of membership qualification

Should any of the following apply to a member, the Company will immediately terminate the provision of the services to the applicable member without the need for prior notice and shall be able to revoke the membership of the applicable member.

  • Should the Company determine that any of the provisions of Article 8: Prohibited acts apply.
  • Should the Company determine that a member registered using false information.
  • Should a member violate the agreement.
  • Should the Company determine that a member is otherwise unsuitable to being a member.
Article 10: Disclaimers
  • The Company shall bear absolutely no responsibility for any damages that may be incurred while using the services or related information, etc.
  • The Company shall bear absolutely no responsibility for any disputes that may arise while using the services.
  • The Company shall be exempt from responsibility for changes in, interruption of, or suspension of the services.
  • Should the registration of a member or information submitted by a member be lost due to a reason not the responsibility of the Company, the Company shall be exempt from responsibility.
Article 11: Changes to the agreement

The Company shall be able to change the terms of the agreement without advance notice to members. Should the agreement be changed, it shall apply to all members. Changes to the agreement shall be announced via the website and email.

Supplementary provisions

This agreement shall take effect from February 1, 2008.
